BURAQVISION SOFTWARE LICENSE TERMS

These terms define how Buraqvision software can be used, deployed, and distributed across Solo, TeamLine, and Cloud platforms. By using our products, you agree to follow these guidelines and respect the modular integrity of our systems. These terms are updated regularly to reflect new features, deployment methods, and licensing improvements.

Clause 0: EULA Acknowledgment Please read this End-User License Agreement (EULA) carefully before completing the installation process and using Buraqvision Software. This Agreement:
  • Grants you a license to use the software
  • Outlines warranty limitations
  • Includes liability disclaimers and usage conditions
By proceeding with installation or use, you confirm acceptance of these terms.
Clause 1: Agreement Overview This End-User License Agreement (EULA) is a legal contract between you (the licensee) and Buraqvision (the licensor). By installing, accessing, or using the Licensed Software, you agree to be bound by the terms and conditions outlined in this Agreement.
Clause 2: Scope of Agreement This Agreement governs your acquisition and use of Buraqvision Software, whether obtained:
  • Directly from Buraqvision
  • Indirectly through an authorized reseller or distributor
These terms also apply to any updates, supplements, internet-based services, and support services unless separate terms are provided at the time of delivery.
Clause 3: Trial Use & Acceptance If you register for a free trial of Buraqvision Software, this EULA also governs that trial period. By installing and/or using the software — whether under trial or full license — you confirm your acceptance of the software and agree to be bound by the terms of this Agreement.
Clause 4: Authority to Accept If you are entering into this Agreement on behalf of a company or legal entity, you represent that you have the authority to bind that entity and its affiliates to these terms. If you do not have such authority, or do not agree with the terms of this Agreement:
  • Do not install or use the Buraqvision Software
  • Do not accept this EULA Agreement
Clause 5: Applicability of Terms This EULA applies only to the Software supplied by Buraqvision, regardless of whether other software is mentioned or described. These terms also govern any:
  • Buraqvision updates
  • Supplements
  • Internet-based services
  • Support services
…provided for the Licensed Software, unless separate terms are provided at the time of delivery. If separate terms accompany those items, those terms shall apply.
Clause 6: Software Limitations The Licensed Software is provided for use as-is, within the scope defined by Buraqvision. Limitations include (but are not limited to):
  • No guarantee of compatibility with third-party systems unless explicitly stated
  • No support for unauthorized modifications, reverse engineering, or redistribution
  • Performance may vary based on hardware, environment, and user configuration
  • Features may be restricted by license tier
  • Offline functionality may be limited without proper activation or updates
These limitations are part of the license terms and must be acknowledged during deployment.
Clause 7: Device-Specific License The Licensed Software is restricted to the specific computer for which it was originally obtained. It cannot be transferred to another computer, device, or environment without prior written consent from Buraqvision. Any attempt to duplicate, migrate, or reassign the software outside the licensed system may result in license termination.
Clause 8: License Grant & Device Use Buraqvision hereby grants you a personal, revocable, non-transferable, and non-exclusive license to use the Buraqvision Software on your devices, in accordance with this EULA. You may install and operate the software on a PC, laptop, mobile, or tablet under your control, provided your device meets the minimum system requirements.

The Developer also grants the Customer a non-exclusive, non-transferable, royalty-free license to use the delivered Work Product.
Clause 9: License File Responsibility The Customer is responsible for keeping the license file secure and intact. In case of loss or damage to the license file, the Customer must pay the full license fee to obtain a replacement. No partial recovery, discount, or transfer will be entertained without written approval from Buraqvision.
Clause 10: Limitation of Liability To the maximum extent permitted by applicable law, Buraqvision shall not be liable for any:
  • Indirect, incidental, special, or consequential damages
  • Loss of data, revenue, profits, or business opportunities
  • Damages arising from the use or inability to use the software
  • Claims by third parties due to your use or misuse of the software
In all cases, Buraqvision’s total liability shall not exceed the amount paid by you for the software license.
Clause 11: Jurisdiction & Provisional Governance Until Buraqvision is formally registered as a legal entity, this Agreement shall be governed by the laws of the country or region where the software is deployed or where the developer resides, whichever is applicable. Any disputes arising from this Agreement shall be resolved under the local jurisdiction of the deployment region, unless otherwise agreed in writing.

Once Buraqvision becomes legally registered, the jurisdiction shall shift to the registered location and this clause will be updated accordingly.
Clause 12: Amendments & Updates Buraqvision reserves the right to modify, update, or amend this EULA at any time. Changes may reflect:
  • Software enhancements or new features
  • Legal or regulatory compliance
  • Licensing model adjustments
  • Deployment or support policy changes
Updated terms will be made available through official channels. Continued use of the software after such updates constitutes acceptance of the revised terms.
Clause 13: Entire Agreement This EULA constitutes the entire agreement between you and Buraqvision regarding the Licensed Software. It supersedes all prior or contemporaneous communications, proposals, or representations — whether oral or written — related to the software.

No verbal or informal assurances shall modify the terms of this Agreement unless formally documented and signed by authorized representatives.
Clause 14: Survival of Terms Certain provisions of this Agreement shall survive termination or expiration of the license, including but not limited to:
  • Intellectual property rights
  • Warranty disclaimers
  • Limitation of liability
  • License file responsibility
  • Governing law and jurisdiction
These clauses remain enforceable even after the software is uninstalled or the license is revoked.
Clause 15: Severability If any provision of this Agreement is found to be invalid, illegal, or unenforceable under applicable law:
  • That provision shall be modified to the minimum extent necessary to make it enforceable
  • If modification is not possible, the provision shall be deemed severed
  • All remaining provisions shall continue in full force and effect
This ensures the integrity of the Agreement even if one part is legally challenged.
Clause 16: Force Majeure Buraqvision shall not be held liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to:
  • Natural disasters (e.g., earthquakes, floods)
  • Acts of government or regulatory bodies
  • War, terrorism, or civil unrest
  • Power outages or internet disruptions
  • Epidemics or pandemics
Such events shall not constitute a breach of this Agreement, and obligations may be suspended for the duration of the disruption.
Clause 17: Notices & Communication All legal notices, license updates, and official communications from Buraqvision shall be delivered via:
  • Registered email address provided by the Customer
  • Official Buraqvision website or support portal
  • WhatsApp or SMS (if opted-in and verified)
It is the Customer’s responsibility to ensure contact details are accurate and monitored. Notices shall be deemed received within 48 hours of dispatch, unless proven otherwise.
Clause 18: No Waiver Failure by Buraqvision to enforce any provision of this Agreement shall not be construed as a waiver of that provision or any other rights. Any waiver must be made in writing and signed by an authorized representative of Buraqvision. A single waiver shall not imply a continuing or future waiver of the same or other provisions.
Clause 19: Assignment & Transfer You may not assign, transfer, or sublicense this Agreement or any rights granted herein to any third party without prior written consent from Buraqvision. Any unauthorized attempt to transfer the license, whether by sale, lease, or delegation, shall be considered null and void. Buraqvision reserves the right to assign or delegate its rights and obligations under this Agreement without restriction.
Clause 20: Third-Party Software & Dependencies The Buraqvision Software may include or rely on third-party components, libraries, or services. These are subject to their own license terms, which may differ from this Agreement. Buraqvision makes no warranties regarding third-party software and shall not be liable for any issues arising from its use, integration, or updates. You are responsible for reviewing and complying with any applicable third-party terms.
Clause 21: Confidentiality & Data Integrity You agree to maintain the confidentiality of any license files, activation keys, deployment credentials, or proprietary documentation provided by Buraqvision. You shall not disclose, share, or publish such materials without prior written consent. Buraqvision will take reasonable measures to protect your data integrity during activation, updates, and support—but is not liable for data loss due to user-side misconfiguration or third-party interference.
Clause 22: Export Control & Compliance You agree to comply with all applicable export laws and regulations related to the Licensed Software. The software may not be:
  • Exported or re-exported to countries under embargo or trade restrictions
  • Used by individuals or entities prohibited by applicable law
  • Deployed in violation of international software distribution controls
Buraqvision reserves the right to restrict access or revoke licenses where export compliance is compromised.
Clause 23: Audit & Verification Rights Buraqvision reserves the right to conduct license audits or usage verification checks to ensure compliance with this Agreement. Audits may be initiated:
  • Upon suspected misuse or unauthorized deployment
  • During support or upgrade requests
  • As part of routine compliance reviews
You agree to cooperate with such audits and provide access to relevant logs, license files, or deployment records. Failure to comply may result in license suspension or termination.
Clause 24: License File Responsibility You are responsible for the safe storage, integrity, and confidentiality of your license file(s), activation keys, and deployment credentials. Loss, corruption, or unauthorized sharing of license files may result in:
  • Suspension or revocation of the license
  • Denial of support or updates
  • Audit flags or technician intervention
Buraqvision is not liable for license file mishandling on the customer’s side. Backup and verification are strongly recommended before upgrades or migrations.
Clause 25: Technician Deployment Terms Technicians authorized to deploy Buraqvision Software must adhere to the following standards:
  • Use only verified license files and activation credentials
  • Follow shortcut maps, SOPs, and validation messages as documented
  • Ensure visual calm, accessibility, and fatigue-free UI/UX during setup
  • Log deployment actions for audit and support continuity
  • Avoid unauthorized customization or third-party interference
Buraqvision reserves the right to revoke technician access or support if deployment protocols are violated.
Clause 26: Legacy & Branding Continuity You agree not to remove, alter, or obscure any Buraqvision branding elements, shortcut maps, badge labels, or modular descriptions embedded within the software or its documentation. These elements are part of Buraqvision’s intellectual property and legacy framework, designed to ensure:
  • Technician empowerment and deployment clarity
  • Audit-ready traceability across upgrades and migrations
  • Consistent user experience across all tiers and regions
Any attempt to rebrand, overwrite, or fragment these elements without written consent shall be considered a breach of this Agreement.
Clause 27: Training, Support & Upgrade Eligibility Access to training materials, technical support, and future upgrades is conditional upon:
  • Valid license activation and audit compliance
  • Use of verified shortcut maps and SOPs during deployment
  • Submission of technician logs or feedback (where applicable)
  • Adherence to branding continuity and modular documentation standards
Buraqvision reserves the right to withhold support or upgrades if deployment integrity is compromised or if technician protocols are bypassed.
Clause 28: Print-Ready Deployment & Archival Rights Buraqvision grants you the right to generate print-ready versions of licensed SOPs, shortcut maps, validation messages, and deployment notes for internal use, technician training, and audit logs. You may:
  • Print bilingual SOPs and feedback templates for technician deployment
  • Archive modular documentation for compliance and legacy traceability
  • Use handheld inkjet printers for on-site tagging, validation, or delivery logs
You may not rebrand, redistribute, or commercialize these materials without written consent. All printed artifacts must retain Buraqvision’s branding, cadence, and modular structure.
Clause 29: Buraqvision Ecosystem Integrity You agree to maintain the structural integrity of the Buraqvision ecosystem across all modules, tiers, and deployments. This includes but is not limited to:
  • Preserving modular naming conventions and shortcut mappings
  • Ensuring cadence consistency in micro-descriptions, badge labels, and SOP headers
  • Avoiding fragmentation, unauthorized forks, or parallel systems that dilute technician clarity or audit traceability
Any attempt to bypass, override, or replicate core ecosystem logic without written consent shall be considered a breach of this Agreement.
Clause 30: Migration & Versioning Protocols You agree to follow Buraqvision’s official migration guides and versioning protocols when upgrading, downgrading, or transferring software instances across devices, tiers, or regions. This includes:
  • Using verified license files and shortcut maps during migration
  • Preserving modular descriptions, badge labels, and SOP headers
  • Logging version changes for audit and technician traceability
  • Avoiding unauthorized forks, hybrid deployments, or parallel systems
Buraqvision reserves the right to deny support or revoke licenses if versioning integrity is compromised or migration protocols are bypassed.
Clause 31: Cost-Impact & Training Statements Buraqvision may provide cost-impact guides and training statements to assist with technician onboarding, deployment budgeting, and institutional planning. These documents are intended to:
  • Clarify hardware requirements (e.g., handheld inkjet printers, RFID tags)
  • Outline technician time estimates and SOP adherence costs
  • Support institutional audits, grant proposals, and upgrade justification
  • Empower technicians with bilingual, print-ready training modules
These materials are advisory and do not constitute a binding financial commitment. Buraqvision reserves the right to update training statements and cost-impact guides without prior notice.
Clause 32: Feedback Loop & Continuous Improvement Buraqvision encourages structured feedback from technicians, auditors, and institutional users to enhance deployment clarity and modular documentation. You may submit feedback via:
  • WhatsApp delivery logs and technician panels
  • Bilingual SOP annotations or shortcut map suggestions
  • Version-specific deployment notes or audit flags
Submitted feedback may be reviewed, modularized, and incorporated into future updates, training statements, or cost-impact guides. Buraqvision reserves the right to prioritize feedback based on deployment scale, audit urgency, and cadence alignment.
Clause 33: Offline-First Deployment & Sync Protocols Buraqvision supports offline-first deployment for environments with limited or intermittent connectivity. You agree to follow official sync protocols to ensure data integrity and audit traceability across offline and online transitions. This includes:
  • Using approved technician SOPs for local caching, sync triggers, and fallback logic
  • Preserving modular validation messages and shortcut maps during offline use
  • Syncing license files, logs, and delivery feedback once connectivity is restored
  • Avoiding unauthorized sync tools or hybrid forks that compromise cadence or audit logs
Buraqvision reserves the right to deny support or revoke licenses if offline deployments bypass sync protocols or fragment ecosystem integrity.
Clause 34: Legal Proceedings & Cost Responsibility In the event of any legal dispute, arbitration, or court proceedings arising from this Agreement or the use of Buraqvision Software, the client shall bear full financial responsibility for all associated costs. This includes but is not limited to:
  • Legal fees, filing charges, and administrative costs
  • Travel, documentation, and representation expenses
  • Damages, penalties, or settlements awarded by the court
Buraqvision shall not be liable for any legal costs, regardless of jurisdiction, outcome, or duration of proceedings. This clause applies even if Buraqvision is named as a party or witness in the dispute.
Clause 35: Jurisdiction & Dispute Resolution This Agreement shall be governed by the laws of the jurisdiction where Buraqvision is legally registered. In case of any dispute, you agree to:
  • Submit to the exclusive jurisdiction of Buraqvision’s designated courts or arbitration panels
  • Avoid filing proceedings in alternate or foreign jurisdictions
  • Resolve disputes through documented correspondence and audit logs before initiating legal action
Buraqvision reserves the right to reject proceedings filed outside its legal jurisdiction or those lacking deployment logs, technician records, or license verification.
Clause 36: Warranty, Ownership & Liability 1. Limited Warranty: Buraqvision warrants that for 30 days following acceptance, the software will be free from material reproducible programming errors and defects in workmanship. If such errors are discovered during the warranty period, Buraqvision shall promptly remedy them. This warranty is void if:
  • You are in default under this Agreement
  • Errors arise from hardware failures, power/environmental issues, or causes unrelated to the software
  • The software or hardware is modified by any party other than Buraqvision
  • Misuse or negligence occurs by you, your employees, or agents
2. Defect Notification: Buraqvision is not obligated to cure any defect unless notified promptly upon discovery, with clear documentation of the issue.

3. Ownership & Licensing Rights: Buraqvision owns and has the right to license or convey title to the software and documentation. No rights or licenses shall be granted that conflict with Buraqvision’s intellectual property obligations.

4. No Malicious Code Warranty: Buraqvision warrants that no portion of the software contains protection features designed to prevent use, including viruses, worms, software locks, Trojan routines, trap doors, or time bombs. Buraqvision further warrants that it will not impair software operation except by court order.

5. Platform Compatibility: Buraqvision warrants compatibility with Windows 10 and onward.

6. No Additional Warranties: The software and accompanying materials are provided “as is”. All risks related to use or performance remain with you.

7. Limitation of Liability: Buraqvision shall not be liable for any damages, including but not limited to:
  • Loss of business profits
  • Business interruption
  • Loss of business information
  • Inability to use the software
Buraqvision makes no guarantees or representations regarding software performance or results.
Clause 37: Installation & Professional Services Installation: Unless explicitly stated in the Purchase Documentation, installation and implementation of the Product is your sole responsibility. Buraqvision is not obligated to modify the Product to ensure compatibility with any specific hardware, operating system, or third-party software.

Professional Services: You may purchase Professional Services from Buraqvision. A formal Statement of Work (SOW) may be issued to define scope, duration, and fees. All pre-paid Professional Services must be utilized within three (3) days of signing the Purchase Documentation or accepting this Agreement — whichever occurs first.

Compensation & Expenses: Professional Services are billed on a time and expense basis, using Buraqvision’s prevailing rates and travel policies unless otherwise agreed. You are responsible for reimbursing reasonable out-of-pocket expenses, including:
  • Economy-class travel
  • Lodging
  • Meals
  • Technician deployment costs (if applicable)
Clause 38: Acceptance & Testing You have 30 days from the delivery of the software to inspect, test, and evaluate whether it satisfies the agreed-upon acceptance. If the software does not meet the acceptance criteria, you must provide written notice to Buraqvision within the 30-day period, clearly stating the reasons for rejection.
  • Upon receiving such notice, Buraqvision shall have 30 days to correct the deficiencies and re-submit the software for evaluation.
  • If no written notice is received within the initial 30-day period, the software shall be deemed accepted by default.
Clause 39: Support & Communication Channels Support: Buraqvision provides standard support for a period of one (1) year from the date of license activation or Purchase Documentation — whichever is earlier. Support includes:
  • Phone-based assistance during designated support hours
  • Email-based troubleshooting, deployment guidance, and SOP clarification
Support is limited to licensed modules and verified deployments. Buraqvision reserves the right to prioritize support based on technician logs, shortcut map adherence, and audit urgency.
